BYLAWS

ELECTIONS

8.1

(a) Elections for LOCAL PRESIDENT, LOCAL VICE PRESIDENT, LOCAL SECRETARY, LOCAL TREASURER or LOCAL SECRETARY-TREASURER shall be held each odd-numbered year.

(b) Elections for STEWARDS and Unit LOCAL EXECUTIVE BOARD Members shall be held each even-numbered year.

(c) All Local Officials shall assume office October 1st following their election or as soon thereafter as they may be elected upon complying with Article 8.10 (c) of the NABET-CWA By-Laws.

(d) Elections for the above Local Officers will be held according to the following schedule:

Nominations Open July 1st

Nominations Close August 1st

Ballots Mailed August 4th

Ballots Due September 1st

Ballots Counted September 5th

(e) Elections to replace officials should follow a similar timetable. [amended 7/9/98]

8.2

All Local Officials shall hold office for TWO (2) years (except Local Officials elected in 1997 & 1998 who will have their terms lengthened by THREE (3) months for a total of 27 months to compensate for the switch of start of term of office from July 1st to October 1st effective in 1999 [amended 7/9/98]), but in each case until removed by the membership under Article 8.16 of the NABET-CWA By-Laws, or until their successors are elected and sworn in.

8.3

(a) In the event that a vacancy should occur in any local officers' position except that of LOCAL PRESIDENT, a special election shall be held to fill the vacated office for the remainder of the.term of office until a successor is elected at the next regular election for such office.

(b) If a LOCAL VICE PRESIDENT succeeds to the office of LOCAL PRESIDENT, a special election for the office of LOCAL VICE-PRESIDENT shall be held.

8.4

All elections shall be conducted by an ELECTION COMMITTEE, who shall be appointed by the LOCAL PRESIDENT and the LOCAL EXECUTIVE BOARD and which shall be composed of THREE (3) members in good standing who are not candidates in the current election. The committee member to serve as Chair shall be designated by LOCAL PRESIDENT.

(a) At the end of each fiscal year, the LOCAL EXECUTIVE BOARD shall determine the amount of money to be transferred to the Local STRIKE FUND.

(b) This committee shall accept nominations signed by at least TEN percent (10%) of the members in good standing of the Unit or Group involved for any candidate for the available office.The committee shall conduct the election.

(c) Any candidate or his/her representative may present to the committee ONE (1) sheet of campaign material to be included in the mailing of the first ballot.

8.5

PROCEDURE:

(a) If there is only ONE (1) eligible candidate for a particular office, he/she shall be considered ELECTED BY ACCLAMATION. The accepted candidates will be only those listed on the ballot.

(b) If a candidate receives a simple majority of the votes cast on the first ballot, he/she shall be declared elected. If no candidate has been elected for a particular office on the first ballot, a second ballot shall be issued. This ballot shall bear the names of the TWO (2) candidates who received the most number of votes on the first ballot in the order of the greatest number of votes received. The candidate receiving a simple majority of the votes cast on this ballot shall be declared elected. Should the second balloting result in a tie, a third balloting shall be held, the ballots bearing the names of the TWO (2) candidates. Balloting shall continue in this manner until one candidate receives a simple majority.

8.6

All elections shall be conducted by secret mail ballot.

8.7

Only members in good standing shall be eligible to vote. Good standing will be established by the LOCAL TREASURER or LOCAL SECRETARY-TREASURER. All members will be assumed to be in good standing unless notified otherwise by the LOCAL EXECUTIVE BOARD.

8.8

Ballots must be counted no later than FIVE (5) days after the due date.

8.9

The results of each balloting shall be posted.

8.10.Any member may challenge the legality of any election by making a complaint in writing to the LOCAL EXECUTIVE BOARD within THIRTY (30) days after the due date. The LOCAL EXECUTIVE BOARD shall act with dispatch upon any such complaint and shall make a full investigation and report.

8.11

The ELECTION COMMITTEE shall retain all ballots for a period of ONE (1) year after the due date, during which time they may be inspected by any member. If no complaint has been filed in writing by that time, all ballots shall be destroyed by fire. In case a complaint has been filed, all ballots shall be held until the LOCAL EXECUTIVE BOARD directs their disposal.

8.12

Following the annual election, a meeting shall be held with all old and any new LOCAL EXECUTIVE BOARD Members in attendance. The old LOCAL EXECUTIVE BOARD Members and OFFICERS shall first hold a meeting. After taking the oath of office, per 8.10(c) of the NABET-CWA By-Laws, the newly-elected Unit LOCAL EXECUTIVE BOARD Members and OFFICERS shall conduct their meeting.

8.13

Following any Local election, the LOCAL SECRETARY or LOCAL SECRETARY-TREASURER will furnish all Employers and Members of the Local an up-to-date roster of Local 43 Officials.

8.14

In other elections not covered by the provisions of the NABET-CWA By-Laws or these By-Laws; or, in the case of referendums, the LOCAL EXECUTIVE BOARD will instruct the ELECTION COMMITTEE as to the manner in which such elections or referen- dums shall be conducted.

8.15

[Topic: Conference/Convention delegates]

Elections for Local Officers and Local Executive Board Members will also be the election of delegates [and alternates] to the NABET Sector Conference and CWA Convention by designating officers as delegates/alternates using the order:

1] Local President

2] Local Vice President

3] Local Treasurer

4] Local Secretary.

According to the number of delegates allowed by the CWA [determined by the Local's membership] from the top of the list, the requisite number of officer[s] will be designated delegate[s] and then the requisite number of officer[s] will be designated alternate[s]. If any of the designated officers are unable or unwilling to attend, the next officer in order will be designated.

If more than 4 are needed for delegates/alternates, LEB members can be designated according to the following procedure:

1] According to who has the largest unit membership, a WDIV or WJBK LEB member is chosen first.

2] From that unit, choose the LEB member who had the most votes in the last regular election.

3] If that person declines, alternate between the units and go through the LEB members in descending.order of number of votes in the last regular election.
